I am not a lawyer. This is just an opinion from a geriatric, overloaded on morning caffeine.
First of all, I would alert the agent if I were the driver. I suspect it would be covered.
I doubt the insurance company would go to court for a "minor fender bender." The claimant probably claimed physical injury and mental anguish.
Finally, the driver, you and anyone reading this should inquire from their car/homeowner/tenant policy agent about an umbrella policy. More so, if you are a homeowner.

Company + P/T employee (driver) is being sued for a minor fender bender. Amount is 1/20th of company insurance coverage. It appears that insurance company has elected to go to court.
Ins company wants to know whether there is any additional coverage anywhere, in case possible award exceeds policy limit.
Would drivers personal car insurance extend any coverage in this scenario?
I sent you a private message tomcat. I won't be participating on this thread.
IANAL but I think in company van, doing company business, driver's insurance would not come into play on vehicle damage.

Dunno. My insurance covers me if I rent a car/van.
NOTE: The initial post indicates that the driver is also being sued.

This isn't a rental, though. It's an employee who has not signed any rental contract, and not out on his own time. Anywho I guess we'll not pass the bar any time soon.

My point; I am covered if I rent a car. I am also covered beyond the limits of the car owner's policy if I am driving a friend's car and an accident occurs.
In this case, the employer's policy takes precedence.
