First of all, I would alert the agent if I were the driver. I suspect it would be covered.
I doubt the insurance company would go to court for a "minor fender bender." The claimant probably claimed physical injury and mental anguish.
Finally, the driver, you and anyone reading this should inquire from their car/homeowner/tenant policy agent about an umbrella policy. More so, if you are a homeowner.

IANAL but I think in company van, doing company business, driver's insurance would not come into play on vehicle damage.

Dunno. My insurance covers me if I rent a car/van.

This isn't a rental, though. It's an employee who has not signed any rental contract, and not out on his own time. Anywho I guess we'll not pass the bar any time soon.

My point; I am covered if I rent a car. I am also covered beyond the limits of the car owner's policy if I am driving a friend's car and an accident occurs.
In this case, the employer's policy takes precedence.
